You expressly agree that your use of the printrequest.ca marketplace is at your own risk. The printrequest.ca marketplace is available on an "as is" basis, without warranty of any kind, express or implied. Neither printrequest.ca nor any of its information providers, licensors, licensees, employees , agents, attorneys, consultants or contractors, or entities within the printrequest.ca distribution network makes any warranty or representation whatsoever regarding the printrequest.ca marketplace, the success of your participation therein as measured in any way, any information, services or products provided or available bvmarketplace or any results obtained through the use thereof. Printrequest.ca hereby disclaims on behalf of itself and all information providers, licensors, licensees, contractors, consultants, agents, entities within the printrequest.ca distribution network, attorneys and/or employees of it any and all warranties including, without limitation
(1) Any warranties as to the availability, accuracy or content of the printrequest.ca marketplace and/ or information, products or services available through the printrequest.ca marketplace; and
(2) Any warranties of title or warranties of merchantability or fitness for a particular purpose. Some provinces do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights, which vary from province to province.

LIMITATION OF LIABILITY

Any liability of printrequest.ca, its information providers, licensors, licensees, employees, agents, consultants, entities within the printrequest.ca distribution network, attorneys or contractors, including, without limitation, any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, deletion, defect, failure of delivery of merchandise, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorized access to, alteration of, or unlawful use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action, shall be strictly limited to the amount already paid by you to printrequest.ca for advertisement in the prior six month period. In no event shall printrequest.ca, its information providers, licensors, licensees, employees, entities within the printrequest.ca distribution network, agents, consultants, attorneys or contractors, be liable for any indirect, special, incidental, or consequential damages, arising out of this agreement, the use or inability to use the printrequest.ca marketplace and/or the sites linked to from the printrequest.ca marketplace or for any breach of warranty. Some provinces do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. You agree that you will not hold printrequest.ca responsible for the selection or retention of, or any acts, errors, or omissions by, any third party in connection with the printrequest.ca marketplace and/or sites linked to from the printrequest.ca marketplace, including, without limitation, those with whom printrequest.ca contracts to operate various portions of the printrequest.ca marketplace and those to whom printrequest.ca provides links to for content, advertising or any other type of data or information. Without limiting the foregoing, printrequest.cas hall have no liability hereunder by reason of any failure or delay in the performance of its obligations on account of strikes, shortages, riots, acts of terrorism, insurrection, fires, flood, storm, explosions, earthquakes, internet outages, computer virus, acts of god, war, governmental action, or any other cause that is beyond printrequest.ca 's reasonable control.

Only Personal Use is Authorized
Under this Agreement, PrintRequest.ca gives you limited permission to access and use the Services only for your personal use, and to copy, distribute and transmit the content of the Services only to the extent that
such copying, distribution, and transmission is automatically done through your browser software incidentally to using the Services for your personal use. You may also print a copy of the information displayed on the Services for your personal use. That means, that except as set forth above, you may not modify, reformat, copy, display, distribute, transmit, publish, license, create derivative works from, transfer or sell any information, products, or service obtained by your use of the Services. This restriction means, among other things, that you may not mirror on your own Web site any portion of the Services or display through your own Web site any results pages or other information from the Services without PrintRequest.ca's express permission.

Your right to access the Services is subject to any limits established by PrintRequest.ca. You agree that you will not use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor or copy the Services except those automated means expressly made available by PrintRequest.ca, if any, or authorized in advance and in writing by PrintRequest.ca(for example, PrintRequest.ca approved third party tools and services). The PrintRequest.ca Web Site contains robot exclusion headers and you agree that you will not use any device, software or routine to bypass our robot exclusion headers, or to interfere or attempt to interfere with the proper working of the Services. Without limitation to the foregoing, you further agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure (as determined by PrintRequest.ca).

The technology underlying, and content within, the Services is owned by PrintRequest.ca and/or its licensors (including PrintRequest.ca's Advertisers and other content providers) and is protected by copyright and other intellectual property or proprietary rights. If you use the Services other than as provided above, you may violate copyright and other laws of Canada, other countries , as well as applicable provincial laws and may be subject to penalties. That would not be a good thing. As between you and PrintRequest.ca, PrintRequest.ca owns and retains all ownership of the technology underlying and content within the Services, and reserves all rights not explicitly granted to you in this Agreement.

Privacy and Data Collection
PrintRequest.ca does not collect personally identifying information from users of the Services unless users have explicitly given such information to PrintRequest.ca(for example, when registering as a Buyer, when becoming an Advertiser or when sending us an e-mail with a question or as part of a contest). PrintRequest.ca's information practices are further described in its privacy policy. PrintRequest.ca's privacy policy is part of this Agreement, and you agree that use of data as described in the privacy policy is not an actionable breach of your privacy or publicity rights. If you
have entered into another agreement with PrintRequest.ca(such as an Affiliate Agreement or an Advertiser Agreement), then you may be subject to additional or different provisions regarding privacy and data collection. If you would like more information, please read our privacy policy. You should consider any communication that you transmit to PrintRequest.ca(such as data, questions or answers, comments, or suggestions) as non-confidential, and agree that PrintRequest.ca will not be liable or responsible if information that belongs to you is intercepted and used by an unintended recipient.

The transmission of data or information (including communications by e-mail) over the Internet or other publicly accessible networks is not secure, and is subject to possible loss, interception or alteration while in transit. Accordingly, we do not assume any liability for any damage you may experience or costs you may incur as a result of any transmissions over the Internet or other publicly accessible networks, such as transmissions involving the exchange of e-mail with us (including those which may contain your personal information). While we shall take commercially reasonable efforts to safeguard the privacy of the information you provide us and treat such information in accordance with our Privacy Policy, in no event will the information you provide to us be deemed to be confidential, create any fiduciary obligations to you on our part, or result in any liability to you on our part in the event that such information is inadvertently released by us or accessed by third parties without our consent.

(a) Buyer Submissions: You may submit your material for your project listing at the Request for Quote Sign-Up form located at http://www.PrintRequest.ca. PrintRequest.ca reserves the right to edit, refuse, reject or remove any project listing at its discretion at any time. You represent and warrant that all information, in the project listing itself or contact information supplied in conjunction with the project listing,
(i) does not violate any law or regulation;
(ii) does not infringe in any manner any copyright, patent, trademark, trade secret or other intellectual property right of any third party;
(iii) does not breach any duty toward or rights of any person or entity including, without limitation, rights of publicity or privacy, or has not otherwise resulted in any consumer fraud, product liability, tort, breach of contract, injury, damage or harm of any kind to any person or entity;
(iv) is not false or misleading; and/or
(v) is neither defamatory, libelous, slanderous or threatening.
(b) Accepting PrintRequest.ca Suggestions: PrintRequest.ca reserves the right to edit refuse, reject or remove any project listing at its discretion at any time. From time to time, (or as part of a particular program) PrintRequest.ca may provide suggestions to you for project descriptions, contact information, or for any other element of a project listing but the final decision to authorize any suggestion is yours. Ideas provided by PrintRequest.ca are only suggestions and you are under absolutely no obligation to use such suggestions. It is your responsibility to determine whether such suggestions comply with the requirements of Buyer Submissions section above. By using information or details in a project listing or contact information that may have been suggested by PrintRequest.ca, you acknowledge that such information and/or project listing is in compliance with the Buyer Submissions Section above and with this Agreement.
PrintRequest.ca reserves the right to change any information, features and functions of the Services without prior notice. PrintRequest.ca may deny you access to all or part of the Services without prior notice if you engage in any conduct or activities that PrintRequest.ca determines, in its sole discretion, violate this Agreement, the rights of PrintRequest.ca or any third party, or is otherwise inappropriate.
Agreement for Use of Site
You agree to follow all applicable laws and regulations when using this website. Furthermore, you agree that you shall not:
    1. upload, post or otherwise transmit through or to this website any content that:
      1. is unlawful, abusive, threatening, harmful,obscene, lewd, offensive, defamatory or otherwise objectionable;
      2. might infringe the intellectual property rights, privacy rights, rights of publicity, or other proprietary rights of others;
contains any viruses, trojan horses, time bombs, or any other harmful programs or elements;
    1. disrupt, place unreasonable burdens or excessive loads on, interfere with or attempt to gain unauthorized access to any portion of our website, its computer systems, servers or networks;

The Web site may allow you to purchase many different types of services online that are provided by PrintRequest.ca (the Services). When ordering Services on the Web site, you must provide complete and accurate personal information consisting of your name, address, telephone number, e-mail address, credit card information and shipping address, as well as any other information requested. Please be advised that any and all purchases of our services shall be deemed to be final as of the purchase date. There will be absolutely no refunds available, therefore it is advised that all service periods be carefully purchased.
Your receipt of an electronic form or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Your submission of an order to us shall be deemed to constitute an offer to purchase, which shall remain open for a reasonable time, unless we agree otherwise, and will be deemed to be accepted by us only upon receipt of our services. PrintRequest, in its sole
discretion, reserves the right at any time after receipt of your order, to accept or decline your order for any reason.
You acknowledge and agree that the price of the Services is subject to change without notice and that the Services are subject to availability. The Web site may allow you to purchase many different types of products and services online that are provided by third parties (the Third-Party Merchandise). PrintRequest is not responsible for the legality, quality, accuracy, timeliness, reliability or any other aspect of any Third-Party Merchandise.
